'this is' Terms and Conditions

Anyone is eligible to submit video clips

MODERATION

Your clip must not infringe copyrights: so be original, or make sure if you use any other creative material that it's out of copyright. If your clip includes any infringing material we will remove it from the 'this is' sites.
Clips must not contain: nudity, pornography, drug use, violence, attacks on individual or group – including sexist, racist, defamatory or homophobic material - obscene material, copyrighted material, material that could be considered dangerous or encourage others to be dangerous. All clips will be passed through a team of moderators and anything that infringes these guidelines will not be uploaded.
Ensure you have the consent from third parties before publishing clips in which they appear. This includes celebrities or public personalities unless your clip is taken in a public setting where the person is aware they might be videoed.
Don't advertise or promote products or services on this site. Any material that is deemed to be advertising will be removed from this site.
Our site moderators will view your clip and assess it against the rules set out above. You agree that we may refuse to publish your clip at its complete discretion (which it will exercise in a reasonable manner). It may also remove and destroy your clip if it believes that it contains content which is illegal or infringes others' rights in any way. It may notify the police or other law enforcement authorities or regulators about illegal content on your clip if it sees fit.
We reserve the right to remove any video clip from this site at any time and for any reason.

COSTS

There is no cost for uploading a video clip to the 'this is' platform
Your carrier's usual costs for sending an MMS apply. You won't be charged for any SMS you receive from us confirming your submission.
To download video clips from 'this is' to your handset has a cost as displayed on this site. Depending on your mobile network, you may also have to pay for the data usage.

WARRANTIES

If your clip includes other people, you warrant that they've consented to be in your clip and to putting your clip on this site. You understand that your clips will be published on the 'this is' website, mobile internet site and for other promotional purposes or material, and so will be able to be seen, shared amongst and downloaded by many other people.
You warrant to us that your clip doesn't breach copyright or other intellectual property rights and that you haven't included or copied anybody else's material without their consent or licence. If you have used other people's material, you undertake to ensure that the original creator has given you permission in advance to use it and to have it published by us on our websites and any other publishing platforms.
You also warrant to us that if other people appear in your clip/s they've licensed you and us to use their intellectual property rights including their images and voices, in all materials and for any purpose required by us without any payment, and that they've waived any moral rights they may have in the clips so that we can use the clips without identifying them and can modify, adapt or alter the clip in any way.
You must not submit a clip which contains material which is defamatory, offensive, obscene, threatening, racially, religiously or ethnically discriminatory, homophobic, illegal (inciting violence, crimes against children, indecency or other crimes), uses someone's image or invades their privacy without their consent.
You agree that we can use your clips for any purposes and you licence us to use these clips in any way we require, including using them in any media and licensing other people to use them on our behalf. You waive any moral rights you have in the clips and agree that we can use the clips without identifying you and can reproduce, modify, adapt or alter the clip in any way it sees fit. If required by us, you agree to assign all intellectual property in the clip to us, in writing
If you're not the account holder for your phone, you warrant that you have the account holder's permission to submit your clip.
Your participation in the 'this is' service is at your own risk. Both we and you are liable to each other for breach of these terms and conditions or negligence under the principles applied by the courts. We are not liable for any loss, damage or injury which results directly or indirectly from your participation in 'this is video' or any of our competitions unless they are caused by our breach or negligence, or if they are caused by you, or if you don't make reasonable efforts to minimise your loss, or if they are due to events outside our reasonable control.

PRIVACY

We respect your privacy. However, if you make your personal information public by including it in your clips, it will become accessible by anyone who uses or views our site. We will comply with all data protection laws active in the UK.
